Anti-Money Laundering
We declare strict abidance to AML (Anti Money Laundering) regulations. You agree that the Company may implement regulations and procedures to adhere to AML regulations at its sole discretion. Credit card deposits should be made only from personal (non-corporate) credit cards registered under your name.
Refunds and withdrawals will be executed only to the credit card from which the funds were originally deposited from.
The Company at its sole discretion shall have the right to pay amounts above the original deposit to a bank account in your name and held in your country of domicile |Corporate credit cards will not be accepted. Depositing by wire shall be made only from a bank account in your country of domicile and from an account in your name.
Refunds and withdrawals in case of a deposit by wire shall be executed to the same account where the deposit has originally been wired from.
Equities Reserves supports the fight against money launderers. Equities Reserves follows the guidelines set by the committee of experts on the evaluation of Anti-Money Laundering Measures.
Equities Reserves is a permanent monitoring mechanism of the Council of Europe, a pan-European organization with 47 member states, reporting directly to its principal organ, the Committee of Ministers.
Equities Reserves is entrusted with the task of assessing compliance with the principal international standards to counter money laundering and the financing of terrorism and the effectiveness of their implementation, as well as with the task of making recommendations to national authorities in respect of necessary improvements to their systems.
Equities Reserves also conducts thematic typologies research of money laundering and terrorist financing methods, trends and techniques. Equities Reserves was originally an observer to the FATF and from June 2015 became an associate member.
If, upon consideration of this circular, a reporter is compelled in the context of a specific dispute or litigation, whether under the Civil Procedure Rules 1998 (CPR) or by court order, to disclose SARs in civil proceedings they should contact the NCA at the first opportunity.
Client/Trader responisbility:
- All clients are liable to declare the source of funds (No exceptions).
- Overcome any AML consequences: all clients must pay Taxes in advance (before withdrawing is sent).
- Refusal to pay: a customer who is refusing to comply with the taxes applied on his account will be reviewed and reported for Tax evasion and money laundry.
General Information about AML
Anti-Money Laundering The operations of the Company and its subsidiaries are and have been conducted at all times in compliance with all applicable financial recordkeeping and reporting requirements, including those of the Bank Secrecy Act, as amended by Title III of the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 (USA PATRIOT Act), and the applicable anti-money laundering statutes of jurisdictions where the Company and its subsidiaries conduct business, the rules and regulations thereunder and any related or similar rules, regulations or guidelines, issued, administered or enforced by any governmental agency (collectively, the “Anti-Money Laundering Laws”), and no action, suit or proceeding by or before any court or governmental agency, authority or body or any arbitrator involving the Company or any of its subsidiaries with respect to the Anti-Money Laundering Laws is pending or, to the best knowledge of the Company, threatened.
Anti-Money Laundering Compliance The Advisor acknowledges that, in compliance with the Bank Secrecy Act, as amended, the USA PATRIOT Act, and any implementing regulations thereunder (together, “AML Laws”), the Trust has adopted an Anti-Money Laundering Policy. The Advisor agrees to comply with the Trust’s Anti-Money Laundering Policy and the AML Laws, as the same may apply to the Advisor, now and in the future. The Advisor further agrees to provide to the Trust and/or the administrator such reports, certifications and contractual assurances as may be reasonably requested by the Trust. The Trust may disclose information regarding the Advisor to governmental and/or regulatory or self-regulatory authorities to the extent required by applicable law or regulation and may file reports with such authorities as may be required by applicable law or regulation.
Anti-Terrorism; Anti-Money Laundering Neither the Borrower nor any Affiliate of the Borrower is (i) a country, territory, organization, person or entity named on an Office of Foreign Asset Control (OFAC) list; (ii) a Person that resides or has a place of business in a country or territory named on such lists or which is designated as a “Non-Cooperative Jurisdiction” by the Financial Action Task Force on Money Laundering, or whose subscription funds are transferred from or through such a jurisdiction; (iii) a “Foreign Shell Bank” within the meaning of the USA Patriot Act, i.e., a foreign bank that does not have a physical presence in any country and that is not affiliated with a bank that has a physical presence and an acceptable level of regulation and supervision; or (iv) a person or entity that resides in or is organized under the laws of a jurisdiction designated by the United States Secretary of the Treasury under Sections 311 or 312 of the USA Patriot Act as warranting special measures due to money laundering concerns. The Borrower is in compliance with all applicable OFAC rules and regulations and also in compliance with all applicable provisions of the USA Patriot Act.
Anti-Money Laundering Program The Distributor represents and warrants that it (a) has adopted an anti-money laundering compliance program (“AML Program”) that satisfies the requirements of all applicable laws and regulations, and (b) will notify the Trust promptly if an inspection by the appropriate regulatory authorities of its AML Program identifies any material deficiency, and will promptly remedy any material deficiency of which it learns.
Anti-Money Laundering/International Trade Law Compliance Such Originator will not become a Sanctioned Person. Such Originator, either in its own right or through any third party, will not (a) have any of its assets in a Sanctioned Country or in the possession, custody or control of a Sanctioned Person in violation of any Anti-Terrorism Law; (b) do business in or with, or derive any of its income from investments in or transactions with, any Sanctioned Country or Sanctioned Person in violation of any Anti-Terrorism Law; (c) engage in any dealings or transactions prohibited by any Anti-Terrorism Law or (d) use the proceeds from the sale of the Receivables to fund any operations in, finance any investments or activities in, or, make any payments to, a Sanctioned Country or Sanctioned Person in violation of any Anti-Terrorism Law. Such Originator shall comply with all Anti-Terrorism Laws. Such Originator shall promptly notify the Administrative Agent and each Lender in writing upon the occurrence of a Reportable Compliance Event.
Money Laundering The operations of the Company and its Subsidiaries are and have been conducted at all times in compliance with applicable financial record-keeping and reporting requirements of the Currency and Foreign Transactions Reporting Act of 1970, as amended, applicable money laundering statutes and applicable rules and regulations thereunder (collectively, the “Money Laundering Laws”), and no Action or Proceeding by or before any court or governmental agency, authority or body or any arbitrator involving the Company or any Subsidiary with respect to the Money Laundering Laws is pending or, to the knowledge of the Company or any Subsidiary, threatened.
